NEW 144G Assisted Living Licensure

Background

In May of 2019, the state legislature passed the new assisted living licensure which is effective August 1, 2021.  This legislation removes the previous Housing with Services Registration 144A.  144G puts in place more standards to keep our elders safe.

There are approximately 60,000 seniors residing in 1800 assisted living facilities in the state of Minnesota.  Most of these seniors will not experience significant changes.  If you have a family member that resides in assisted living or memory care that is impacted, you should have been notified of this change by May 31.

Why the Change?

-stronger consumer protections including discharge protections

-stronger regulation of Dementia Care services

-less confusion for consumers and regulators-comprehensive regulation of the building and services

Impact

All residents living in senior  housing with services should have received and information by July 1. Due to the new licensure, some things may change.  For example, to standardize things, meals are not included in the monthly rent.

We believe that the new standards will provide more protection for residents in senior living.  And, as you would expect, it will take some time to understand the impact.

There are increased costs for the facilities to meet all the requirements and pay for the licensure.  We anticipate seeing costs for residents increasing due to increased regulation.
